Any prices, ranges, or estimates displayed on the Site (including through our project profile tool) are industry-average reference figures and do not constitute a quote or contractual offer from Fair Marble. Final pricing is determined only after a free in-home measure and signed written estimate.
Financing offers (including any promotional 0% APR or 12-month payment terms) are subject to credit approval, third-party lender terms, and availability. Fair Marble does not extend credit directly.
4. Product Information and Availability
We strive to ensure product information, images, and specifications on the Site are accurate, but cannot guarantee that all descriptions are complete, current, or error-free. Cabinet, countertop, flooring, and backsplash availability is subject to manufacturer supply.
5. Intellectual Property
All content on the Site, including text, graphics, logos, images, and software, is the property of Fair Marble or its licensors and is protected by United States and international copyright, trademark, and other intellectual-property laws. Manufacturer logos and product images belong to their respective owners.
6. User Submissions
When you submit photos, sketches, measurements, or messages through our forms, you grant us a worldwide, non-exclusive, royalty-free license to use that content for the purpose of providing services to you. You are responsible for ensuring you have rights to share the content you submit.
7. Third-Party Links and Embedded Content
The Site contains links to third-party websites and embedded content from services such as Elfsight (Google reviews, Instagram feed) and Google Maps. We are not responsible for the content, privacy practices, or terms of those third parties.
8. Disclaimer of Warranties
THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Manufacturer warranties on products purchased through Fair Marble are provided directly by the manufacturer. Workmanship warranty terms are provided in your written installation contract.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAIR MARBLE LLC, ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
10. Indemnification
You agree to indemnify and hold harmless Fair Marble LLC and its affiliates from any claim, demand, or damage (including reasonable attorneys' fees) arising out of your use of the Site or violation of these Terms.
11. Governing Law and Venue
These Terms are governed by the laws of the State of Connecticut, United States, without regard to its conflict-of-law principles. Any dispute arising under these Terms shall be brought exclusively in the state or federal courts located in Fairfield County, Connecticut, and you consent to personal jurisdiction in those courts.
12. Severability
If any provision of these Terms is held to be unenforceable, the remaining provisions shall continue in full force and effect.
